Welcome to Caldera Creative. By accessing or using our
website, booking a call, or engaging our services, you agree to the following
terms:

1. Services Offered

Caldera Creative provides automation consulting and system implementation for
small and local service-based businesses. Services may include strategy
sessions, audits, chatbot and SMS automation setup, CRM integrations, and
follow-up campaigns.

2. No Guarantees

We strive to improve your lead response and workflow systems, but we cannot
guarantee specific results (e.g., number of leads, booked calls, or revenue
increases). Your success depends on your industry, client base, and
implementation.

3. Payments

All payments for services are due in advance unless otherwise agreed. Monthly
subscriptions may auto-renew unless canceled.

4. Intellectual Property

All materials we create (e.g., workflows, automations, written content) remain
our intellectual property unless otherwise agreed in writing. You may not
reproduce, resell, or share our systems without permission.

5. Client Responsibilities

Clients agree to provide timely access to platforms, accounts, and information
needed to deliver services. Failure to do so may delay delivery or reduce
effectiveness.

6. Confidentiality

We respect your business confidentiality. Any information shared during your
project will be kept private and used only to deliver agreed services.

7. Cancellations & Refunds

Custom builds are non-refundable once development begins. Monthly services may
be canceled with 15 days’ written notice prior to the next billing cycle.

8. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising
from your use (or inability to use) our services.

9. Modifications

We may update these terms occasionally. Continued use of our website or
services after updates means you accept the new terms.

10. Website Design & Setup Scope
All plans that include website creation, setup, or customization are limited to the development of a standard marketing website with the following scope:

Up to 5 core pages (e.g., Home, About, Services, Contact, Blog).

Customization of pre-built templates available within the platform.

Basic branding setup: logo, colors, fonts, and content placement.

Contact form integration, basic SEO settings, and social media links.

The included website is designed to meet the needs of most small businesses and professionals. It does not include:

Custom app development or advanced backend coding. Membership systems, e-commerce integrations, or LMS builds unless explicitly included in the plan. Unlimited revisions or design from scratch without the use of templates.

Requests beyond this scope may be subject to additional fees, which will be quoted separately. We reserve the right to define what constitutes a “standard” build based on the resources allocated per plan.

11. Ongoing Service Requirement
All services provided by Caldera Creative — including but not limited to AI chatbot development, marketing automations, SEO enhancements, website setup, and CRM support — are offered exclusively as part of an active subscription plan.

Access to these services requires a current and fully paid subscription to Caldera Creative. If a subscription is canceled, paused, or becomes delinquent, all related services may be suspended or revoked, including:

Access to AI chatbots or automations

Hosting of landing pages or websites

Scheduled content posting or SEO tracking

Support or troubleshooting services

CRM and workflow assets provisioned under the account

We do not offer these services as one-time or stand-alone purchases unless explicitly stated in a separate agreement.

Reactivation Policy: If a subscription is reactivated within 30 days of cancellation, services may be restored at our discretion. After 30 days, a re-onboarding or rebuild fee may apply.
